Informative note related to the art.13 of Legislative Decree n.196 of June 30, 2003 on the Protection of Personal Data and to the article. 13 of the EU Regulation 679/2016 – General Data Protection Regulation (“GDPR”)

PURPOSE, LEGAL BASIS AND OBLIGATORY OR OPTIONAL NATURE OF TREATMENT

Data gathered from website during its functioning are used in order to be able to perform real estate agency activity, to provide a service or an operation, agreed upon within a contract, to verify progressing of the contractual relationships as well as risks connected to them.

Your identification data will be treated also for to get absolved from the obligations imposed by the State Laws, regulations and EU regulations, or from the dispositions issued by the authorities that are legally authorized by law and control or surveillance institutions. Such treatment doesn’t request consent of the interested party.

The information relative to your property will also be subject to treatment for promotion and commercial in order to provide for the correct execution of the entrusted mandate, and therefore can be subject to diffusion through publication on internet, social network and/or paper publications of the data controller, through his explicit consent.

Your electronic mail address can be used by the Data Controller to send promotional communications about products and services similar to those provided, as per the paragraph 4 of article 130 of Legislative Decree196/2003. You can refuse at any moment treatment for such purpose. You refuse will not have any effect on the main purpose of the performance of the real estate agency activity.

THE RECEPIENTS

Your data will be shared with our administration staff and our external collaborators. Their list is available in our head office upon request. The data will also be shared with our service suppliers, such as IT service suppliers, outsourcing services companies, consultants and freelance professionals, insurance companies, debt collectors, fraud controllers, institutions and charitable institutions, nominated responsible for a specific treatment. Moreover, your data can be shared with technicians for any verification with Cadaster and/or other institutions or Registers, of the property of your interest.

TRANSFER

Some of your Personal Data are transferred to the recipients who could be outside of European Economic Space. The Data Controller ensures that the electronic and paper treatment of your Personal Data by the recipients happens in conformity with the Applicable Regulation. Indeed, the transfer is based alternatively on a decision about suitability or on the Standard Model Clauses approved by European Commission. DATA STORAGE

All the bestowed personal data will be treated in respect of principles of lawfulness, correctness, relevance and proportionality, only in the ways, also telematic and IT, strictly necessary to reach the above described goals.

In any case, personal data will be stored for a period of time not superior to those strictly necessary in order to reach indicated goals. Personal data, which are not necessary to store in relation to the indicated goals will be cancelled or transformed in anonymous form. It is underlined that the IT systems, used to manage gathered data are configured from the start in order to minimize the use of data.

YOUR RIGHTS

Finally, let us remind you that as the involved person, you have the rights as per the Art. 7 of Privacy Codex and Art. 15 of GDPR, and precisely rights to:

1) obtain the confirmation of the existence (or non-existence) of the personal data regarding yourself, even if they are not registered yet, and the communication of such data in intelligible format;

2) obtain the information about: a) the origin of the personal data; b) the reasons and ways of data treatment; c) the logic applied in case of treatment executed with help of electronic instruments; d) identification data of the Controller, Responsible and the Representative entitled as per Art. 5, comma 2 Privacy Codex e art. 3, comma 1, GDPR; e) the subjects or categories of subjects with whom the personal data can be shared or who can become aware of the data as an entitled State representative in the territory, of responsible or entitled ones;

3) obtain: a) update, correction, or when interested, integration of data; b) cancellation, transformation into the anonymous form or block of data treated with violation of the low, including those which are note necessary to be stored in order to reach the goals for which the data have been gathered or subsequently treated; c) certificate about the fact that those with whom the data had been shared or diffused, have been informed about the operations described under the letters a) and b), except the case in which such action reveals to be impossible or implicated use of means manifestly non-proportional in comparison with the protected right;
